Felony Indictment issued by the Ashland County Grand Jury on Ashland Man

Ashland County Grand Jury has issued seven count Felony Indictment against Amado Herrera-Reyes for the following charges:

COUNT ONE: GROSS SEXUAL IMPOSITION a felony of the fourth degree.

COUNT TWO: GROSS SEXUAL IMPOSITION a felony of the fourth degree.

COUNT THREE: PANDERING OBSCENITY INVOLVING A MINOR OR IMPAIRED PERSON a felony of the second degree.

COUNT FOUR: PANDERING OBSCENITY INVOLVING A MINOR OR IMPAIRED PERSON a felony of the second degree.

COUNT FIVE: PANDERING OBSCENITY INVOLVING A MINOR OR IMPAIRED PERSON a felony of the second degree.

COUNT SIX: PANDERING OBSCENITY INVOLVING A MINOR OR IMPAIRED PERSON a felony of the second degree.

COUNT SEVEN: PANDERING OBSCENITY INVOLVING A MINOR OR IMPAIRED PERSON a felony of the second degree.

COUNT ONE: GROSS SEXUAL IMPOSITION a felony of the fourth degree.

In that on or about January 1, 2022 through February 7, 2023, in Ashland County, Ohio, AMADO HERRERAREYES, did have sexual contact with “Jane Doe” (DOB: xx/xx/2007), not his spouse, when AMADO HERRERA-REYES purposely compelled such person(s) to submit by force or threat of force, in violation of Ohio Revised Code

SPECIFICATION ONE TO COUNT ONE:

The Grand Jurors further find and specify that the offense as stated in Count One was committed while the said AMADO HERRERA-REYES is the owner and/or possessor of one (1 ) Celero 5G smart phone which was contraband and/or property derived from or through the commission or facilitation of the offense, and/or was an instrumentality the offender used or intended to use in the commission or facilitation of the offense and is subject to forfeiture pursuant to 2941 .1417 (A), 2981.02, and 2981.04 of the Revised Code.

In that on or about January 1, 2022 through February 7, 2023, in Ashland County, Ohio, AMADO HERRERAREYES, did have sexual contact with “Jane Doe” (DOB: xx/xx/2007), not his spouse, when AMADO HERRERA-REYES purposely compelled such person(s) to submit by force or threat of force, in violation of Ohio Revised Code

COUNT THIRTEEN: ENDANGERING CHILDREN a felony of the second degree.

In that on or about January 1, 2022 through February 7, 2023, in Ashland County, Ohio, AMADO HERRERAREYES, did entice, coerce, permit, encourage, compel, hire, employ, use, or allow “Jane Doe” (DOB: xx/xx/2007), a child under eighteen years of age, to act, model, or in any other way participate in, or be photographed for, the production, presentation, dissemination, or advertisement of any material or performance that the offender knew or reasonably should have known was obscene, was sexually oriented matter, or was nudity-oriented matter, in violation of Ohio Revised Code

COUNT FOURTEEN: POSSESSING CRIMINAL TOOLS a felony of the fifth degree.

In that on or about January 1, 2022 through February 7, 2023, in Ashland County, Ohio, AMADO HERRERAREYES, did possess or have under the person’s control any substance, device, instrument, or article, to wit: one (1 ) Celero 5G smart phone with purpose to use it criminally, in violation of Ohio Revised Code Section 2923.24(A), 2923.24 POSSESSING CRIMINAL TOOLS, a felony of the fifth degree.

FURTHERMORE, the circumstances indicate that the substance, device, instrument, or article involved in the offense was intended for use in the commission of a felony, to wit: Pandering Obscenity Involving a Minor or Impaired Person, ORC Sections 2907.321 (A)(l) & 2907.321 (C), and/or Illegal Use of Minor or Impaired Person in Nudity-Oriented

Material or Performance, ORC Sections 2907.323(A)(2) & 2907.323(B), and/or Gross Sexual Imposition, ORC Sections 5(A)(1) & 2907.05(C)(1) and/or Endangering Children, ORC Sections 2919.22(B)(5) % 2919.2

SPECIFICATION ONE TO COUNT FOURTEEN:

The Grand Jurors further find and specify that the offense as stated in Count Fourteen was committed while the said AMADO HERRERA-REYES is the owner and/or possessor of one (1) Celero 5G smart phone which was contraband and/or property derived from or through the commission or facilitation of the offense, and/or was an instrumentality the offender used or intended to use in the commission or facilitation of the offense and is subject to forfeiture pursuant to 2941.1417(A), 2981.02, and 2981.04 of the Revised Code.

to wit: one (1) Celero 5G smart phone COUNT FIFTEEN: TAMPERING WITH EVIDENCE felony of the third degree.

In that on or about February 1, 2023 through February 7, 2023, in Ashland County, Ohio, AMADO HERRERAREYES, did, knowing that an official proceeding or investigation was in progress, or was about to be or likely to be instituted, alter, destroy, conceal, or remove any record, document, or thing, with purpose to impair its value or availability as evidence in such proceeding or investigation, in violation of Ohio Revised Code Section 2921 .12(A)(1 2921 .12(B), TAMPERING WITH EVIDENCE, a felony of the third degree.

SPECIFICATION ONE TO COUNT FIFTEEN:

The Grand Jurors further find and specify that the offense as stated in Count Fifteen was committed while the said AMADO HERRERA-REYES is the owner and/or possessor of one (1) Celero 5G smart phone which was contraband and/or property derived from or through the commission or facilitation of the offense, and/or was an instrumentality the offender used or intended to use in the commission or facilitation of the offense and is subject to forfeiture pursuant to 2941.1417(A), 2981.02, and 2981.04 of the Revised Code.

and against the peace and dignity of the State of Ohio.

Ohio Special Response Team Joins Search

 

 

The Ohio Special Response Team and the Ohio Highway Patrol Aviation Unit joined the search for Timothy Metcalf, a 74-year-old, white, male, who simply walked away from his residence in Ashland on Monday, around 8pm, and hasn’t been seen since.

Ashland Police Division Captain, Craig Kiley, said in a phone call today, that they are trying to pin down a direction that Metcalf may have went. No public search has been organized yet. If anyone wants to call the Police Division and leave their phone number we can contact them, if a public search is needed.

Tim was known as a walker and often walked miles, so it is difficult to say with any certainty where he may have went, commented Captain Kiley. Every effort is being deployed in this search.

In a press release on Tuesdays, it was reported that Mr. Metcalf is 5’11”, weighs 185 lbs., with graying hair, a beard, and hazel eyes. He was last seen wearing blue jeans and a navy-blue coat. He likes to frequent parks and nature preserves in the Ashland County area, and walks to them regularly.

Captain Kiley commented, we have been knocking on doors and asking the public and business to look at their cameras to see if they may have caught Mr. Metcalf on their cameras, Monday around 8pm.

On their web-Site https://www.ohiospecialresponseteam.org/ says, “OSRT NEVER SELF DEPLOYS and there is NEVER A CHARGE FOR OUR SERVICES.”

MISSING ADULT ALERT

 

The Ashland Police Division is investigating the report of a missing, 74-year-old, white, male. Timothy Metcalf walked away from his home on the north side of Ashland last night at approximately 8:00 pm. He left his cell phone and wallet at the residence, and did not report to work today. Mr. Metcalf has been experiencing a significant amount of stress lately and his family is concerned for his wellbeing due to the uncharacteristic behavior.

Mr. Metcalf is 5’11”, 185 lbs., with graying hair, beard and hazel eyes. He was last seen wearing blue jeans and a navy-blue coat. He likes to frequent parks and nature preserves in the Ashland County area, and walks to them regularly.

Mr. Metcalf may have asked someone for a ride, or to use a phone. If you see him, or know where he may be, please call the non-emergency line at 419-289-1911, or dial 911 if he is in distress, to report the specifics.

Ashland County Prosecuting Attorney Christopher R. Tunnell announced today that the Officer of the Month for February 2023 is Ashland County Sheriff Deputy Garrett Dudte.

Deputy Dudte has shown a relentless pursuit of criminals through a high level of self-initiated activity. By using his training, experience, and instincts, Deputy Dudte has created positive outcomes in high pressure situations. Month after month, his efforts have resulted in felony cases involving narcotics, firearms, and more. His report writing skills are strong and he is proactive when it comes to conducting necessary follow-up. Deputy Dudte’s diligence reflects the high standards of law enforcement in our community and we are grateful to have him protecting our county.

Prosecutor Tunnell stated, “Deputy Dudte has drawn the attention of my staff by his consistency. He is consistently making cases by staying alert and aggressively pursuing the criminal element. He’s a hard-charging go-getter.”

AU English Department Presenting Poetry Reading by Saeed Jones on March 2

ASHLAND, Ohio – The department of English at Ashland University is sponsoring a poetry reading by visiting writer Saeed Jones on Thursday, March 2, at 7 p.m. It will take place at the Student Center Auditorium inside the Hawkins-Conard Student Center (847 Claremont Ave.), and is free and open to the public.

Jones will read excerpts from his critically-acclaimed book, “Alive at the End of the World.” A collection of poems that confront the haunted condition of Black life in America, it was selected to “Best Books of 2022” lists by The New Yorker, NPR and Publishers Weekly among others. Utilizing a combination of memoir, fiction and persona, Jones addresses everyday perils as he and his speakers seek ways to love and survive through America’s existential threats.

Jones is the award-winning author of “Prelude to Bruise” and “How We Fight for Our Lives.” The former was named a 2014 finalist for the National Book Critics Circle Award for poetry, while the latter won the Kirkus Prize for Nonfiction in 2019.

Jones was born in Memphis, Tenn., grew up in Texas and now lives in Columbus, Ohio. His work has appeared in The New Yorker, The New York Times and GQ, and he has been featured on a number of public radio programs.
